MICHIGAN STATE HOUSING DEVELOPMENT AUTHORITY NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAMS Michigan State Housing Development Authority (MSHDA) Address: 735 E. Michigan Ave, Lansing, MI 48912 Phone: 517-335-4661 On or after October 2, 2018, MSHDA will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Federal funds under itle (HOME Investment Partnership Act) of the National Affordable Housing Act of 1990, and Section 8 (o)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 1437f(o) (13)) as amended, to undertake the following MSHDA intends to award Northwest Michigan Community Action Agency up to $176,000 for conducting approximately six homeowner rehabilitation activities Location: Communities of the City of Cadillac, Garfield Township in Grand Traverse County, and East Bay Township, in Grand T County Level of Environmental Review Citation: 24 CFR Part 58.5(a) (3)0) Project/Program Description: Homeowner rehabilitation may consist of repair or replacement of roofs, windows, doors, siding, porches, lectrical, handicap access, septic, connection to municipal water or sewer, structural and other improvements to existing structures needed to meet UPCS Review of Environmental Laws and Authorities: ATier 1 broad review of the area has been completed and no compliance issues were identified. A Tier 2 site-specific environmental review will be completed for those laws and authorities not addressed in the Tier 1. This will be done for each address under this program when addresses become known. The Tier 2 site-specific review will cover the following laws/ authorities: Airport Hazards, Flood Insurance, Coastal Zone Management, Contamination and Toxic Substances, Floodplain Management Historic Preservation (State Historic Preservation Öffice & Native American Tribes), Noise Abatement & Control, Wetlands Protection. The activity/activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.5(a)(3)0). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Housing Initiatives Division of MSHDA, 735 E. Michigan Ave., Lansing, MI 48912 and may ned or copied weekdays 8 A.M to 5 PM PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to MSHDA's Housing Initiatives Division. All comments received by October 1, 2018, will be considered by MSHDA prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION MSHDA certifies to HUD that Earl Poleski and/or Andrew Martin, MSHDA Certifying Officers, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Northwest Michigan Community Action Agency to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and MSHDA's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by a Certifying Officer of MSHDA; (b) MSHDA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58: (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal age acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
